Hi guys

My lovely Giulia Veloce was rear-ended last week by a Waitrose Merc Sprinter van who鈥檚 brakes had failed - John Lewis have accepted Full liability.

Waiting to hear if the car can be repaired or will be written off, but I suspect it may be the latter

It鈥檚 a lease can that I鈥檝e had for 11 months, and I鈥檓 unsure where I stand legally for out of pocket expenses ...... let me explain.

The car is leased from Leasys and was on a 2 year deal with 9 months down - Gap waiver was included. According to Leasys if the car is written off they will get full value of a new car and will terminate my lease and I鈥檒l need to take about a new lease.
The issue here is that I鈥檒l have lost my 9 months upfront payment as Leasys have confirmed they will not provide a pro-rata refund and I鈥檒l need to pay another 9 months as an initial payment.

This means that I鈥檒l be around 拢3k out of pocket for an accident that was not my fault.
Has anyone any experience of claiming this back as out of pocket expenses?

Does GAP not cover the deposit? Check the documents.
Unfortunately not according to Leasys - they just suggested trying to recover the cost from John Lewis.

Seems Leasys are in a win-win situation as they鈥檝e had equivalent of 20 months payment from me (initial 9 + 11) and if written off will get fully compensated for a new car ..... plus another 9 months from me if I decide to take a new lease. 馃が

I remember seeing posts like yours on Pistonheads and the recommendation was specific GAP insurance for lease cars. Too late for you now unfortunately but maybe something to look into next time.

I recall specifically asking the dealer for a gap insurance quote at the time but they declined saying there was no value as gap waiver was included with the lease ...... not quote the same thing as it turns out

Hi Mate - really sorry to hear this. I too lease my Giulia, have leased cars for as long as I can remember. I always take out GAP cover with an independent specialist which typically covers this scenario. None of which really helps you now. Perhaps your insurer maybe able to help you to recover some of your loss?

Check your own Insurance as most reputable ones offer new car replacement if total losses if your car is less than 12 months old. Your Insurers will then recover from the tp insurers.

I feel from an indemnity perspective JL should cover the costs here. Its an accident. Its not your fault. Indemnity is part and parcel of an insurance policy. To bring you back to a position on no loss and no gain. Worth talking to JL.

I suggest that you also contact the leasing ombudsman. I haven鈥檛 got details with me but Leasys themselves give you the details if you complain! They clearly will have an element of 鈥渦nused鈥 lease money if the vehicle is replaced like for like under GAp insurance and they do not have any depreciation or interest to pay. At the very least they should be able to contribute.

However, I am sure you will be able to recover uninsured losses. Just a pain in the ****.

Leasys are a shambles!!!

Thanks for all the advice - much appreciated 馃憤

One thing I should have mentioned is that John Lewis contacted me directly admitting liability and offering to pay for the repairs directly...... which after spending almost 4 hours just trying to get through to someone at my insurance company (Axa) I was more than happy to do.
However, in hindsight I鈥檓 now not sure that was the right thing to do as I鈥檒l need to recover any expenses directly myself. Having said that, JL have been very good so far.

I would go back to John Lewis and explain the situation - the costs are a direct result of the accident, you should not be out of pocket...

I made enquiries today re a new lease and I was shocked at the difference in cost !
I took my lease out 11 months ago and for 15k miles per year it was 拢295 per month with 9 months down. The same deal is now apparently 拢482 per month, so an increase of 拢187 a month 馃槺
To make it worse, I underestimated my mileage and really need a 20k mile lease which will bump the price up further.

Does anyone know where to get the beast lease deal at the moment, as if it鈥檚 拢482 then I鈥檓 afraid my time with a Giulia will have been permanently cut short and I鈥檒l need to rethink my options.

Needless to say I鈥檓 gutted 馃槬

Thats really unfortunate for you buddy. Have you tried getting quotes from somewhere like Carwow?

The crazy thing is I can lease a Merc AMG CLA45 for less than the prices I鈥檓 seeing for a replacement Giulia Veloce.

It does appear that Alfa heavily subsidised the early leases, but now that they鈥檝e removed support they no longer appear competitive.

Disappointed that Leasys would not just allow me to continue with my existing lease considering they鈥檒l be getting a replacement vehicle under the insurance settlement. I can鈥檛 really blame them as they鈥檝e had equivalent of 20 months payment from me plus the value of a new car once settled and the option of getting someone on a new more profitable lease.

Gutted for you. Seeing a Giulia in that state is heart braking. As others have said, GAP insurance is available for lease deals, it's just dealers are not allowed to offer it... stupid I know!

As JL have admitted liability, I'm sure you won't end up out of pocket.

Daft idea, but given Alfa are now doing 5 year warranties and 0% finance, would buying be an option? I guess at 20k per year, it might not be worthwhile.
