Not Happy Clamped in my work car park

Firstly, deep breath......................

I am still very, very, very, very, very angry and upset.

In short I came to get in my car this evening and found that the University 'security' (and I use that term loosely) had deemed it necessary to clamp my car!

Why? Well seemingly it was parked in an area deemed 'not suitable for parking, causing a possible obstruction to pedestrians and other vehicles'!

A bit of background............

.............the University of Liverpool charges its staff to park in their poorly patrolled, unsecured (no officers on site, no cameras), easily accessable car parks. The reason: to pay for the barriers they installed on each car park and to try and reduce the numbers of cars on campus (ie. a 'green' excuse). I have to travel 25 odd miles to work, I do not live close to the University and pay approx £30 a month to park in a car park that until last year was free to park in and had been for the previous 10 years I worked at the University.

With this came a new 'regime' of parking rules which I obey. I have parked in the same space on and off for 5 years and never not even once (even when other 'illegally' parked cars in the car park have been clamped) have I received a warning not to park my car in that space. The space is in a hatched yellow area but is itself not a hatched area - it is laid out as a car space as is the space in front of it. As I say never have I seen a car parked in either space being clamped until today. I have pictures of my present car and my last Alfa parked in the same space from this year and last year.

So why was I clamped? Well the 'security officer' told me that there was a crack down this week - 'not that you were targeted of course Sir'. So how come today it's illegal but yesterday and Monday and all of the previous years it wasn't? He doesn't have an answer.

Do I suspect a money making racket? Surely not

Anyway I had to pay £30 for the thing to be taken off and then come back to find, yes you guessed it (and I suspected it) the alloy has been gouged where the clamp was . The 'security' guys and their clamp were gone before I got back to the car (I had to walk across campus to pay the fine, they people in the van wouldn't take payment ).

I am going to appeal and as I was phoning 'security' I was approached by a fellow member of staff (who regularly parks her Mini in the other 'illegal' space to tell me that she would gladly offer her name and support to an appeal. She like me has been parking in these spaces for years and never has received as much as a warning.

Anyway rant over, sorry it is very long and probably contains many spelling mistakes () but I am so disappointed that my employer would treat me like this

Clamping by private security organisations is illegal in Scotland and should be in England. You have my sympathy and good luck with the appeal.

Bad luck and typical of the way and reason that this country has deterioted and why were in the **** now.

Someone suggested that you can leave a sign in your car stating that force will be used to remove any immobilsation device applied to your car. If you get clamped in a private car park, crack out the petrol grinder and off with the clamp, not alot they can do. Bit extreme but could be interesting.

Anyway, if they've damaged your car persue a claim against them starting by submitting the bill and then if necessary small claims.

I would be thinking about revenge. Maybe not now, but in a week or two. You don't want it to be too obvious.

I would also thinking about taking them to task over the damage to the wheel. I am sure there is something in the law that is on your side with regards to this, as wheel clamps should not cause damage.

They have damaged your car ... THEY have to pay to sort it out, if they won't do it amicablly then get your insurance company (with the legal protection that you've obviously paid for) to sort it out.

Thanks for the replies so far. What makes it worse is that I am out of there come Christmas

I am going to write a letter of appeal and start there. Unfortunately I don't have a picture of the car with the clamp on but have pictures of the car parked there on other dates when it wasn't clamped.

Diamond flat alloys can't be repaired so I am told

Make sure you get pics of the alloys then ... they'll have to buy you a new one

Diamond flat alloys Jim, the alloys fitted to my 159. The dealer told me they can't be repaired due to the 'special' finish on the wheel. I don't know if this is true or not

I am drafting a letter and gathering photographic evidence to support my case today and tomorrow

The dealers word is good enough if they say they cannot be repaired.
Make sure you ask them to put it in writing though, as well as a quote for a new one.

There will probably be traces of paint from the clamp on the wheel, that could be used as evidence as well if things go that far.

You can sue them for damage, like they can sue you if you remove the clamp (for damage to the clamp).

Sorry to hear about this Bunster

The Car Park here is 'patrolled' by a private clamping firm and one guy got stiffed for 260 HTF is that right in a company car park

He hadn't displayed his pass properly apparently but when they do these checks they have a list of all the registrations of pass holders but obviously didn't check it as they are supposed to before taking any action !!
