Alfa 159 TI - Gutted!!

Unfortunately I have had to cancel my Alfa 159 TI order from Auto Lusso, ordered in February and still no idea when it will be arriving, clearly they are last in the line (after all dealers Worldwide!) to receive their orders. Disappointed is an understatement and I've also lost 500!!

I think you could probably claim your deposit back through the courts if the supplier refuses to refund, if you can be bothered I'm sure the court would find in your favour. How can a supplier keep a deposit if the supplier can't actually supply the goods nor tell you when they are going to be able to. Moral is to read the small print and delete anything you don't agree with and get countersigned by the supplier and get a date agreed on any deposit orders so if they don't supply by that date the supplier must refund your deposit. If they won't do that, don't leave a deposit. This is just my personal opinion and a comment on deposits in general.

The contract is the key here. The loss of the deposit for a cancelled order is written into the contract I believe.

Here, there is always a delivery date on the contract.
If the car doesn't turn up by that date (which is
always "padded out" by the dealer to around 2 months)
then the order can be cancelled and the deposit is returned
in full.

But then again the deposit is usually 10%, so much higher
figures are at stake.

This is a common issue with AL as far as I can tell though (being careful at the risk of having plug pulled on this thread).

The court will find in your favour if it decides that it was "An unfair contract" in the first place. Which might well be the case. Worth a go through the small claims Court.
