Official, my son is not a burglar!

For those who followed my previous thread on this subject, the Lowestoft police finally had to admit today that my son was wrongly arrested on two counts of suspicion of burglary. We got a very nice apology for the inconvenience caused ( the night in the slammer, the worry, stress, etc) so that's alright!
No case to answer ( we knew this six weeks ago) but his DNA is now on the national database apparently (it might be on that, but it sure as hell wasn't at the crime scene)
He'll have no record or anything
So no harm done then!

I take it you're still believe that the police acted wrongly then? What do you think they should have done differently?

I believe you can write to the police and request the DNA is removed from the database as no charges were brought. The comments on the earlier thread about it being there for life are incorrect.

What I was getting at SR was that when I read your comment, the immediate impression I gained was that "fitting up" was common enough in the police for us to be grateful that it did not happen in this particular case. That's how it struck me anyway.

We are entitled, I think, to a better standard of professional conduct from the police forces than that above. As a result, not having manufactured evidence against RF's son is no more than we should ever expect.

glad to hear common sense has prevailed in the end richy. now write to them and request that his dna is removed from the database before the government lose it somewhere along with his bank details, passport number, health records etc etc...

Good news RF and I can understand your frustration. But all that remains to be done is to have your sons DNA record removed and to put the incident behind you. I suppose there may be a day you'll be glad of the police.

I am extremely glad he has been completely cleared, although I don't think his DNA should be removed. I believe that everybody's DNA should be on system. Just in case.

Didn't do the crime but still doing the time, get a good brief and take them to the cleaners, then maybe you'll be able to afford the VED next year.

What he said. You should be able to get a fair bit of compo for this, then maybe the police will learn not to be so heavy handed next time. Might pay for your son's first car to be an Alfa

Yes the police are doing their job in this instance not so well and too hasty to make a conviction, why did they subject a young person to a night in jail when he was claiming he was innocent and on the way home through the area. Why not speak with the youths parents and entrust them, subject to further investigation. It must have been traumatic I'd like to see the opinions of those people on here if it was an experience they had with a son or close relative. Don't think they'd empathise with the hasty action of the law.

Oh yeah. Go get some compensation. That's a cracking idea. It's the answer to every problem.
The police had reason to suspect he may have been guilty of a crime so they arrested him, held him for questioning, investigated, and let him go as an innocent.
Clearly they've done something horrendously wrong, let's string 'em up.
And while we're at it, lets sue them for loadsamoney. Because of course, the police force having LESS money will clearly improve their service to the community in the future

Oh yeah. I didn't think of that. Because a guilty one certainly wouldn't have claimed he was innocent.

Clearly the police shouldn't ever arrest someone until they've already proved they're guilty. I'm confused though... what are the courts for in that case?

You cant sue the police for arresting the wrong person - otherwise how would they ever do their job. There would be gangsters running here there and everywhere cos the police would be too scared to arrest them in case they got off somehow. They went through due process and investigating crimes can involve arresting innocent people, its not nice on the innocent people but the police have to do it if not to eliminate people from enquiries.

With regard to compensation etc, I guess I've mellowed a bit over the weeks and just want to put the incident behind me. His DNA is on the national database so i guess it could be used to eliminate him just as easily as to incriminate him in the future.
It was the manner of the arrest that I found hard to take. The way they were handled made it clear that they were assumed to be guilty.
I haven't lost confidence in the police because I didn't have much to begin with.

Court of appeal laid down guidelines for compensation following wrongful arrest, £500 for the first hour, and less for each subsequent hour on a downward sliding scale.. I say you should pursue this, the police's response to this was totally over the top, a complete waste of resources and unnecessary punishment for a someone who's only real "crime" was to have a police dog bark at him..

Could the police not have taken the young lad back home or let his dad take him home after the processing of his arrest, instead of banging him up in a cell for 16 hours? If DNA evidence had come back implicating him he could have been picked up from home for further questioning..
