... but if it's a boring drink like water, then it's half full

if you have been drinking from a full glass and you stop in the middle, you are emptying it so it is half empty...if you start to fill an empty glass up and then stop half way....you are filling it back up again so then it is half full

But what if it's evidence in a murder case and you're presenting it to the court? Or it's an auction item and you're trying to write a description? Or someone just handed it to you and you don't know it's history? Or if you;re drinking it while someone else is filling it up, so skillfully that the level never actually changes?
