Auto Lusso Deposits

Is anyone having problems with Auto Lusso in getting their deposits returned?
In December last year I rang to order 2 x 159ti for myself and my business partner, they then as agreed deducted my credit card for 2000. My partner changed his mind before confirming the order and they said they would refund the card 1000. In May I rang to cancel the other car as I need a replacement for mine and cannot wait indefinately any more, Auto Lusso said fine and agreed to refund the deposit.

It is now June 19th and guess what? They still have 2000 of my money! I have rung on numerous occasions, there is never anyone available to talk about it, they have not returned one call. They say the person who deals with credit cards only works Fridays, so I ring on a Fridays and she is never there to talk to, and does not ring back! I have sent letters, copies of credit card receipts and still no response.

I sent a final letter recorded delivery a week ago, still no answer. If I dont hear from them by next week then I will have to go down the legal action route This is the last thing I want to do as it wastes my time and costs money.

I initially thought they were just incompetent but I now suspect something worse...

Your letter is indeed on my desk and I was going to deal with it tomorrow but it looks like you have saved me the cost of a stamp by bringing this to a public forum.

You ordered 2 cars one for your business partner and one for your self, you entered into the contract as a business not a consumer therefore your contract is subject to out company terms and conditions which are available from the front page of our web site.

As a gesture of good will, when you cancelled the first car we were going to allow you to use this deposit towards the second car.

You have now cancelled both cars and as a commercial customer and as per our terms and condition you are not entitled to your deposit back.

I have sent a copy of your post to my solicitor and he feels your post is defamatory and I suggest you consider editing it, if not it will be us taking you to court not the other way around.

I actually take Ned's side though, dont hand over a deposit until you are happy with the terms and conditions.

I understand why you say that but on the other hand it is good for us potential customers to get a transparent view of how Alfa businesses run. At the end of the day disputes like this are quite common, although avoidable.
I think too many people have forgotten what a deposit is for. reading between the lines I think AutoLusso have behaved very well. They could have just taken the first 1000 on cancellation but instead said it could be used against the other car. When that was cancelled I can't blame Ned for keeping the deposit.
It's good to be transparent.

absolutely. i think when it comes to a transaction between an individual and a business, a lot of people think all the weight of commitment & responsibility is borne by the business when in reality both sides have to accept a certain amount once a contract has been entered into.

Well, from the customers perspective I think the customer has a point to make and out of pure frustration, has posted here. (Rightly or wrongly)

If you sign terms and conditions then you should have taken time to read and understand them, but like everything you dont expect things to go wrong do you.

However Ned!!! I must admit that no one likes T&C's thrown at them although I guess this is your only defence here on an open forum, I hear what you are saying about the deposit scenario above but if it all gets out of hand from either party then we will remove the thread. Therefore keep it civil and it can be discussed like grown men, thats if others allow it?

Despite what others may suggest later in this thread... We will not oversee/protect or hide any business issues at AO!

But hang on, in Jon's original post, if he is to be believed, and I'm not suggesting he is or he isn't, he says with regards to the first car 'they said they would refund the card 1000'. Then with regards the second car being cancelled 'Auto Lusso said fine and agreed to refund the deposit'.

Why shouldn't he expect his money back assuming the above is true?
