buggered engine

my cam belt went back in january and it got repaired by my local stealer who was kind enough to charge me for a recon head.. since the repair was carried out the engine failed yet again due to the head repair(large piece of metal blocked oil pipes in sump? ) took the car to a independant specialist who replaced the engine with a recon one.. got an enginers report stating all this! so far the whole cam belt snapping episode has cost me over 2500... do i have much chance of getting any of this money back?

Presumably you agreed to the recon head?

As you've now changed the engine elsewhere and (I think) not given the original garage the chance to re-repair then I feel you have very little chance in getting any recompense from the first garage. I'm not a legal eagle but I have had dealings with a garage in a similar situation. I found that you need to give the garage at least one go at re-fixing it, regardless of how much you detest them. That way if they failed again then you look much better in court as you've given the benefit of the doubt to the garage, and are seen to be acting reasonably yourself. Sorry for the negative view.

The dealer should have been informed and given a chance to repair it. Saying that, with a qualified engineers report you may be able to get something sorted, either amicably or via the small claims court.

I think you will get some money back on the basis of the engineers report, although it may not be the full amount because you didn't give the original garage a chance to fix it.

Yes, you should of given the stealers a chance to fix it, but i know (more than most) that when they have messed up that badly the people you want touching your car is them. Having said that so long as you have an independant engineers report stating the issue was due to the recon head, then a small claims court IMO would find in your favour.

I would send a strongly worded letter to the stealer with a copy of the engineers report asking for your money back. failing that if you paid on a credit card you can dispute the transaction with them.
