Naughtiest
Driver A, began an overtaking manoeuvre on Driver B in an urban 40mph limit, albeit approaching the National speed limit signs.
Driver B, was doing 40ish mph and waited until the national speed limit signs, before sticking the boot down, leaving driver A behind and on the wrong side of the road seemingly for no reason
Who gets sent to the naughty corner?

Both of them, driver A for starting the manouvre in a 40 zone and undoubtedly exceeding 40 mph in the process, he should have waited for the national speed limit zone. Driver B for being such an arrogant **** when he saw he was about to be overtaken.

driver b. 40 is 40 until you pass the signs.
I left many a boy racer behind in my old chevy Camaro in exactly this situation, they would sit right behind me, as I sat at precisely 40, then just before the signs, they would pull out, and start to overtake.
exactly where the national speed limit signs were, I'd floor it, drop two gears (kickdown on the auto box) and utterly annihilate them, only reaching about 60 then backing off, but bejeesus, that thing was very, very, very fast 40 - 60
why would you try and overtake a 5 liter V8 just on a speed limit change when you were driving a vauxhall nova anyway?

I'm led to believe the smokey Alfas are quite good at this too, maybe not V8 good, but definitely not slow.
I have a feeling that driver B was just doing the same thing he does every day, as he seems inclined to stick to the urban speed limits more so than the national speed limit,
coincidently, I sort of see where he is coming from as I've always thought of the national signs as more of an 'end of speed limit' sign

I voted for driver B, as its quite a dangerous thing to do and could have caused an accident
However, on a road with clear visibility, or on a dual carriage way, it would be good fun

If Driver B hasn't looked in his mirror out of his side window, and was at the speed limit, then why shouldn't he accelerate at the usual place. I never saw in the highway code you had to check your mirror before accelerating, just any other manouvre!
Driver A doesn't need sending to the naughty step as his red face is punishment enough

That driver A is a dick is a given.
If the road was obviously clear ahead I'd give driver B the benefit of the doubt. If there was any sort of oncoming traffic or other danger, then he's a dick too.

In the defence of Driver B
- The other car was never at any stage in front of me, I'm not even sure he got much past my back bumper
- I'm sick of being overtaken in the 40 limit only to get held up on the open section. Both ends of this road (my daily commute) have long straights with a 40 limit, at one end it's alongside a play park / playing fields, which is one of the reasons I stick to the limit
- There was no danger to anyone at any point, passengers C & D were indeed both on board,
either way I appear to be of to the naughty corner for the thread title, so I will not be about for the next 38 minutes

A year or two ago I was driving on the A55 (dual carriageway) in roadworks, so I was stuck at 40mph. A Volvo decided to tail gate me, and as soon as we got to the end of the roadwork moved into the righthand lane to try and overtake me. I was expecting this and had already changed down to 3rd and so booted it as soon as he moved over. I had a big cheesy grin on my face as I watched him disapear in my rear-view mirror  right up to the point when the police stopped me
