Fiat faces court challenge from US

I've followed this story closely. From what is reported (ANE being the best site), the regs in Europe state that the emissions control can be switched on and off to protect engine and components.

The US regulators are saying that because FCA didn't tell them this, it is a breach. FCA say they didn't tell them as its part of the normal running of the engine. You will note FCA are being very deliberate in stating they fiercely dispute the "deliberate" misleading of the tests.
From what I can gather FCA say they see why the US regulators aren't happy and have provided a fix. But they stressed again no deliberate effort was made to mislead

Incidentally it is the same thing the German Gov is getting all excited about

I don't know about engines, specifically, but according to AutoWeek, it's the "2014-16 Jeep Grand Cherokee and Ram 1500 models" that are at the heart of the issue.

"As FCA US announced last week, it has developed updated emissions software calibrations that it believes address the concerns of EPA and CARB, and has now formally filed for diesel vehicle emissions certification with the regulators for its 2017 model year (MY) Jeep Grand Cherokee and Ram 1500 diesel vehicles," the company said in a statement. "Subject to the permission of EPA and CARB, FCA US intends to install the same modified emissions software in 2014-2016 MY Jeep Grand Cherokee and Ram 1500 diesel vehicles. FCA US believes this will address the agencies’ concerns regarding the emissions software calibrations in those vehicles."

Well this is the Good Ole' "Land of the Stoopid" we're talking about.

The CARB will doubtless waste thousands of US taxpayers' dollars pursuing the case just to prove how vigilant they are.
FCA will defend it, at more expense.
The judge will get confused and rule that the case is not proven, since it doesn't sound like a case of systemic cheating even to a layman like me..
US.Gov will end up stitched with a load of FCA's costs and legal fees.
VW, Daimler et al will continue to sell their vehicles without any punishment or having to pay much compo' (at least in Europa/The Fourth Reich).
Everybody is happy because "The Evil Corporations" have been rumbled and the environment has been saved... :thumbu p:
