Exceeding speed limit on A66

Hi, My friend was driving my car but I have received a notice of intended prosecution for exceeding 50MPH speed limit by 8 miles on A66 West Long Newton Road works Stockton on 7/4/08. Friend ha sgone abroad as he was a student. Is there any chance I can argue a case against it? I would appreciate it if anyone would offer help. Hasan

If what you say is true, then all you have to do is fill in the section of the NIP stating who the driver was.

Assuming for a moment though that the driver was you, I would strongly advise against trying to get out of it by claiming it was someone else. If they have any camera angle which shows you in the driver seat then suddenly you're up for perjury, not speeding - and that's a hell of a lot more serious.

Also was your "friend" insured to drive the car? They will ask for proof and its loads of points and a big fine ( for you) if it turns out he wasn't insured.

Actually, it would be the person who was driving (without insurance) who would be done for it, not the registered keeper of the car. Otherwise we'd all just drive around without insurance and have the car registered in someone else's name!

Nope, not correct, if you let someone drive your car knowing they have no insurance you can also get 6 points for it.

If your 'friend' was insured to drive his own car he would almost certainly be insured 3rd party to drive yours. That's the only legal requirement.

I'm not denying you might be right, but can you point me in the direction of the section of a law that says this? I've just done a quick search and can't find anything about a person getting points on their license for permitting another to use their car uninsured. You don't even need a license to be the registered keeper of a car..

I can't point you in the direction of the law, but I can tell you that when I was driving my brothers vehicle, due to a communications c6ck up on insurance I got done for No insurance and got a fine and points. My brother got the same size fine and also points IIRC

Hahaha, the good old foreign friend trick.

If it's true (and I'm not doubting it is) then just fill in his details in the appropriate box.

If it's not, then I would suggest befuddling them. Fill in your own details in the wrong box. Apparently 20% of NIPS that get completed incorrectly are lost in the system. Worth a punt I'd reckon. They then have to have everything completed within 6 months of the offence, so come November you're ok
