It wouldnt neccessarily be an MOT failure as the brake works , possibly one pad not being as efficient but it could well be within the tolerance. My old renault suffered this and walked an MOT brake test................It is likely that one or both plungers/sliders is siezed and will need replacing..
However it is safer to get it repaired as the ability to stop is foremost on ones mind when driving at speed...lol
