Do I need to replace the tyre?

I clipped a curb yesterday and made a small split in a 1 day old tyre where it meets with the alloy. I'm at work today, so sent a photo to a tyre fitter. He said that it doesn't need to be replaced unless you can see any threads. And only then would it be an MOT failure.

Just wanted a second opinion from your good selves.

Can you post better photos?? Hard to see from that.
If its just the rim protection part of the tyre then it will be fine.

I would. I had a similar chunk out of the 18" tyre on my previous Alfa and the MOT guy put it down as a warning.

As the majority of the strength of the tyre is in the wall, I wouldn't take the risk.
