Additional damage caused by roadside assist
I am posting this as I need some impartial advice in relation to where I stand in the following situation. Firstly I must take full responsibility for not replacing the timing belt on my 156 now that it's at 84k. I bought it at 56k and am unsure if the belt was ever done and as it's not on the service history, I expect it wasn't. I am on the road daily and as you can tell from 56k to 84k in two years is considerable.
I have got the car serviced twice since I got it but it was just the regular oil change, filter change, bulbs etc...no belt work.
So the situation:
Was driving recently and got an error message on the onboard computer VDC system failure with the accompanying amber engine light on the speedo and the engine stopped. I pulled over, called my insurance who put me onto roadside assist. I explained the situation to them including the fact that the car had high mileage and that the timing belt needed to be done. I got my brother to tow the car home and I took another car on my onward journey, had to go to a meeting.
The garage that was sending the truck out rang and I gave them the same details i.e. high mileage and the timing belt situation etc. The recovery driver was aware of the problem when he called for the car however I wasn't back home by the time he arrived. According to both him and my mum, who was taking pictures of the car at the time, he attempted to start the car and there was an unmerciful bang and a plume of black smoke..Iím guessing the t-belt just broke. Now instead of looking at 600EUR to repair the car i.e. replacing the T-belt tensioners etc I'm looking at @ least 2700EUR. My question here is whether I'm entitled to have any of the costs of repairing the car covered by the guy who tried starting it with the information I had given him and seemingly caused more damage.
I would really appreciate your thoughts on this. As an aside this is my second 156 and this is the first ounce of trouble I've had. I really looked after my first one and just got complacent with this one. Was gonna trade it in January for a GT.
