my brother in law once hit a badger at high speed taking the most of the front of a company escort off in the impact, on his form he had to draw a diagram, so he drew 'road, car, badger.'
In the section which said 'In your opinion who is to blame for the accident?'
the comment in that column was simply 'the badger'

Well, it's honest and succinct.

Similar thing happened years ago when my dad and I were driving home from Edinburgh. Blasting up a woodland road in his old Saab, a suicidal pheasant wandered into the road, and unerringly matched every change of direction dad made to try and miss it. Took out the headlight, and I'm not sure what dad wrote on the insurance form. I'll have to remember to ask him.

I think that the whole issue hangs on whether you get your excess back from the other bloke's insurance company after the claim has been made. Do not forget that you have to claim that back.
The insurance companies seem to see it as the deciding factor on whether your NCB is affected or not. Could be wrong though!
