Huw, I've got to be careful here.
to (badly) summarise the law, goods may be returned for a full refund if there's a 'persistant defect' unless the item in question is a car, when as long as the dealer says they'll keep fixing it, that's ok.
if you don't get on particularly well with your dealer, go see the deler principle ( or next best senior management) with your V5 and keys, be prepared to leave the car there ( arrange a lift? ), and have a polite but firm conversation using words like 'persistant defect' 'fit for purpose' 'known problem' 'public domain' 'trading standards' 'local press' 'internet usergroups' and so on, basically politely threatening to rubbish them if they don't help you out.
That said, your gripe is with Alfa, not the dealer, so you need to keep the dealer on your side if you can.
Since the upgrade parts are on allocation, and costing Alfa about £2,000 a go, you can understand the resistance, you just have to overcome it.

maybe £150 spent on a first meeting with a solicitor would be money well spent, it was for us, and now there's a 'fix' in the public domain, you've got a stronger case than we had for demanding the upgrade on safety grounds.
or you could just go out and burn disks and pads as fast as possible, 100 miles and an afternoon is usually enough !
